Terms & Conditions

Last Updated: 28 June 2025  ·  Effective Date: 28 June 2025

These Terms and Conditions ("Terms") govern the use of the Fusee Atelier website at https://fuseeate.cyou and the watch and clock repair services offered by Fusee Atelier ("we", "us", "our") at 43 Jalan Kota Laksamana 4, 75200 Melaka, Malaysia. By using this website or engaging our services, you agree to these Terms.

1. Definitions

2. Acceptance of Terms

By submitting the website enquiry form or bringing a Piece to the workshop, you confirm that you are at least 18 years of age, have the legal capacity to enter into a service agreement, and agree to these Terms. If you are acting on behalf of another person (such as a family member who owns the Piece), you confirm that you have authority to do so.

3. Service Description

Fusee Atelier operates a watch and clock repair workshop in Melaka, Malaysia. We offer three defined repair programmes: Quartz Module Renewal, Dial Restoration, and Pocket Watch Conservation. Full scope details for each Programme are published on our Solutions page. Services are available to clients in Malaysia and, on an agreed basis, to clients who can arrange delivery and collection. We accept Pieces by appointment only.

4. Website Use

No account registration is required to use this website. You may use the website only for lawful purposes. You must not attempt to interfere with the website's operation, extract data by automated means, or use the website to submit false or misleading information.

5. Intellectual Property

All content on this website — including text, images, and design — is the property of Fusee Atelier or is used with permission. You may not reproduce, distribute, or use any content from this website without our prior written consent. The Fusee Atelier name and associated visual identity are not licensed for use by third parties.

6. Payment Terms

Prices are stated in Malaysian Ringgit (RM). Programme Rates are as published at the time of engagement. Work outside the stated scope of a Programme will be quoted separately and must be approved by the Client before it is carried out. No additional charges will be added without prior agreement. Payment is due in full upon collection of the Piece. We accept cash and bank transfer. Pieces will not be released until payment is received in full.

If a Piece is not collected within 90 days of the completion notification, we reserve the right to treat it as abandoned and to charge a storage fee or, after further notice, to dispose of it in accordance with applicable Malaysian law. We will make reasonable attempts to contact you before taking any such step.

7. Service-Specific Terms

Scope changes: If disassembly reveals a fault or missing component not visible at intake, we will describe the additional work, quote for it, and wait for your approval before proceeding. We will not carry out additional work without your agreement.

Timelines: Bench durations stated for each Programme are working estimates based on normal conditions. If circumstances require an extension, we will contact you before the stated completion date. We are not liable for delays arising from factors outside our control (supply of materials, unforeseen technical complexity discovered after intake).

Photographic approval: For Dial Restoration and Pocket Watch Conservation, we will seek your approval by photograph before proceeding with each irreversible step. Approval constitutes your agreement that the work may proceed. If we are unable to reach you after two attempts over 14 days, we may proceed at our discretion to avoid unreasonable delay to other clients.

Cancellation: You may cancel an engagement before work begins at no charge. Once a Programme has begun, you may cancel by notifying us in writing. In that case, you will be charged for work completed to the point of cancellation, assessed at a rate proportional to the Programme Rate.

8. Condition of Pieces

By submitting a Piece, you confirm that you own it or have the authority of the owner to submit it for repair. You agree to inform us of any known defects, previous repairs, or modifications at intake. We are not responsible for pre-existing damage that could not reasonably have been identified before disassembly.

9. Disclaimers

Our services are provided with reasonable care and skill. However, repair and conservation work on mechanical and electronic timepieces carries inherent risk, particularly with aged or fragile components. We do not warrant that a Piece will function to any particular specification after service, where the piece's condition at intake makes such an outcome uncertain. We will advise you of significant risks before proceeding. Information on this website is provided for general reference and does not constitute professional horological advice specific to your piece.

10. Limitation of Liability

To the extent permitted by Malaysian law, our total liability to you in connection with any service shall not exceed the Programme Rate paid for the service in question. We are not liable for indirect, consequential, or special losses arising from service delivery or non-delivery, including loss of sentimental value (except where caused by our gross negligence).

11. Indemnification

You agree to indemnify Fusee Atelier against any claims, losses, or expenses arising from your breach of these Terms, your provision of false or misleading information, or your submission of a Piece that you did not have authority to submit.

12. Termination

Either party may withdraw from a service engagement before work begins. Our right to terminate this agreement extends to situations where you have provided materially false information or where we determine on reasonable grounds that we cannot complete the work to our standards. Sections 8–14 of these Terms survive termination.

13. Dispute Resolution

These Terms are governed by the laws of Malaysia. Any dispute arising under these Terms shall first be addressed through direct communication with us at [email protected]. If a dispute cannot be resolved informally within 30 days, it shall be referred to the courts of Malaysia, with Melaka as the preferred jurisdiction.

14. General Provisions

These Terms constitute the entire agreement between you and Fusee Atelier in relation to our services and supersede any prior representations. If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force. Our failure to enforce any provision is not a waiver of that provision. You may not assign your rights under these Terms without our written consent.

15. Changes to These Terms

We may revise these Terms from time to time. Changes will be published on this page with a revised date. Continued use of the website or submission of a Piece after a revision constitutes acceptance of the updated Terms.
